CBS, Tony Romo could be heading for a high-stakes legal battle - NBC Sports

CBS placed lead NFL analyst Tony Romo on leave "until further notice" via a brief press release issued Friday, and quickly promoted J.J. Watt to the network's top broadcast team, signaling Romo's absence will extend into the 2026 season.

Reporting from Andrew Marchand of The Athletic suggests CBS may be seeking a way out of Romo's contract, which has four years and $72 million remaining.

The dispute centers on the contract's morals clause, a typically broad and vague provision covering conduct that brings an employee into public disrepute, scandal, or ridicule, or that reflects unfavorably on the network.

CBS could argue that Romo's arrest for suspicion of operating while intoxicated, his behavior during a recorded traffic stop and failed field sobriety test, and an alleged open container of alcohol in his vehicle amount to a violation of that clause.

A "for cause" termination cutting off Romo's pay would likely trigger a major fight, though an arbitration clause—if included—would keep the matter out of open court rather than producing a public lawsuit or trial.

Romo's lawyers would likely try to show the morals clause is being used as a pretext by identifying other CBS broadcasters who engaged in similar conduct without being fired, while CBS may see a "nothing to lose" incentive to attempt paying nothing, since losing arbitration would still leave them owing the full $72 million.
