Judge delays Luigi Mangione’s state murder trial after double jeopardy claim - NBC News

New York state Justice Gregory Carro postponed Luigi Mangione's state murder trial, giving prosecutors until Oct. 9 to respond to a double jeopardy motion filed by his attorneys on Friday.
The trial on a second-degree murder charge in the 2024 killing of UnitedHealthcare CEO Brian Thompson had been scheduled to begin next month.
Mangione's lawyers argue the state charges should be dismissed because he already pleaded guilty to federal stalking crimes; New York's double jeopardy statute is considered favorable to defendants, allowing dismissal arguments even when federal and state charges differ.
The Manhattan district attorney's office declined to comment Monday but said it was prepared to litigate the motion and remained committed to seeking justice for Thompson and his family; a source said the office intends to fight the motion until the federal sentencing outcome is known.
During Friday's hearing, Mangione detailed his plan to kill Thompson and admitted fatally shooting him, saying he was motivated by his experiences with the healthcare system, and revealed he posed as an investor managing over $50 billion in an email to confirm the location of the conference Thompson attended on Dec. 4, 2024.
Prosecutors have said they will seek a life term, with Mangione's federal sentencing scheduled for Dec. 18; he still faces state second-degree murder and multiple gun possession counts, to which he pleaded not guilty.
